요약 : By comparing the experience of the two orders, this study argues that the Grey Nuns won their case against Bishop Gilmour because their pontifical status provided recourse outside the diocese and elevated the order's position in the eyes of the Holy See. In addition, a number of influential clergy and canon law specialists defended the sisters' position. Finally, an unyielding mother superior refused to acquiesce. These advantages proved instrumental when compared to the experience of the Sisters of Charity of St. Augustine, a congregation that lacked strong leadership and pontifical approval.

요약 : Gilmour, like most American bishops, insisted he should hold title to ostensible church property as the representative of the faithful, who had contributed financially to the orphanages. Both orders asserted that they were the rightful owners because the institutions depended on contributions from local Catholics and Protestants as well as on proceeds from goods produced by the sisters. Moreover, the sisters staffed the orphanages and trained the personnel. After years of conflict, the Sisters of Charity of St. Augustine transferred their property to the bishop. Utilizing Roman intervention, the Grey Nuns were able to continue holding title to their disputed property.

요약 : In a broader sense this paper addresses the institutional growing pains of the American Catholic Church in matters both religious and secular. The 1870 doctrine of papal infallibility resulted in the strengthening and centralization of papal authority throughout the Catholic world. In this environment, American bishops found themselves in a precarious situation as they sought to redefine their power within these newly prescribed limits. At the same time, clergymen and members of religious orders interpreted their roles and overwhelmed the Holy See with continued calls requesting papal intervention in numerous disputes. American Catholic nuns utilized this centralization to protect the interests and autonomy of their orders.

요약 : This dissertation probes the power struggle between bishops and women religious during the nineteenth century. In the 1880s Richard Gilmour, second bishop of the Cleveland diocese, demanded the property titles belonging to two separate orders of women religious. Both congregations had built orphan asylums on their respective parcels and had administered the institutions for over a quarter of a century. The sisters refused to acquiesce to Gilmour's demand.
