요약 : Chapters one and two analyze the definitions of illegitimacy in Roman law and society, the writings of the church fathers, and the secular law and church councils of the early Middle Ages. They also examine attitudes toward clerical marriage, celibacy, and sexuality, which heavily influenced the institutional church's construction of illegitimacy between the eleventh and thirteenth centuries. Chapter three analyzes papal decretals on illegitimacy and dispensations in the context of the formation of canon law and papal administration.

요약 : The dissertation concludes that the medieval church's interest in illegitimacy resulted from its desire to control the definition of valid marriage and licit sexual activity. It argues that illegitimate individuals could be seen as representations of their parents' immorality. The children of clerics in particular were defined as illegitimate and barred from orders partially because their existence contradicted the newly constructed public image of the clergy, although the laws applied to all illegitimate men. Ecclesiastical records, however, show frequent dispensations and greater access to dispensations than canon law implies. There is a qualitative difference between dispensations appearing in papal records (frequently dealing with sons of priests and men with important positions), and those contained only in episcopal records (often sons of the laity and unbeneficed clerics). The records suggest that illegitimate individuals could reach high positions in the clerical hierarchy, and appear to have obtained benefices in roughly the same percentage as legitimate men.
